This Partner Policy and Acceptable Use Policy (“Policy”) governs the relationship between Hyperfy (“we,” “us,” or “our”) and our Partners who use the Hyperfy platform and related services (“you,” “your”). By becoming a Partner and using our platform, you agree to comply with this Policy.

Failure to adhere to this Policy may result in suspension or termination of your access to the Hyperfy platform, as well as potential legal or regulatory consequences.

1. GENERAL OBLIGATIONS OF PARTNERS

1.1 Compliance with Laws and Regulations

Partners must operate in full compliance with all applicable laws, regulations, and industry standards.

1.2 Adherence to Acceptable Use Guidelines

You agree to ensure that the creation, deployment, and use of AI Agents comply with this Policy and do not violate any applicable laws, regulations, or third-party terms.

2. PROHIBITED BUSINESSES AND ACTIVITIES

You may not use the Hyperfy platform to create, deploy, or manage AI Agents for any illegal activities or for businesses, products, or services that fall within the categories listed below. This includes, but is not limited to:

2.1 Illegal Activities

• Activities involving illegal products or services.
• Promotion or facilitation of illegal drugs, drug paraphernalia, or substances designed to mimic illegal drugs.

2.2 Harmful or Offensive Uses

• Promotion of violence, hate speech, or unlawful discrimination based on race, religion, disability, gender, sexual orientation, or other protected characteristics.

2.3 Adult Content

• Pornography, escort services, or other adult-oriented businesses.

2.4 Gambling and Betting

• Games of chance, gambling, lotteries, or betting systems.

2.5 Financial Services

• Unauthorized financial activities, including predatory lending or debt collection.
• Cryptocurrency mining or unauthorized digital asset activities.

2.6 Intellectual Property Infringement

• Distribution of counterfeit goods or unauthorized use of trademarks, copyrights, patents, or other intellectual property rights.

2.7 Dangerous Materials and Weapons

• Sale or distribution of firearms, ammunition, explosives, or hazardous materials.

2.8 Deceptive Practices

• Pyramid schemes, multilevel marketing, or “get rich quick” schemes.

2.9 Other Restricted Activities

• Unfair, deceptive, or abusive acts or practices.
• Reselling government services without authorization or added value.

3. PAYMENT AND FINANCIAL OBLIGATIONS

3.1 Accurate Disclosure of Business Purpose

Partners must provide accurate and complete information about the nature of their AI Agents and associated activities.

3.2 Payment Compliance

All payments processed through the Hyperfy platform must adhere to applicable laws and industry standards.

4. DATA SECURITY AND PRIVACY

4.1 Protecting End Customer Data

Partners must ensure that all End Customer data processed by their AI Agents is handled in compliance with applicable data protection laws, including GDPR and CCPA.

4.2 Data Breach Notification

In the event of a data breach involving AI Agents, you must notify Hyperfy and any affected parties without undue delay and cooperate fully with investigations and remediation efforts.

5. ENFORCEMENT AND REMEDIAL ACTIONS

5.1 Investigation of Violations

Hyperfy reserves the right to investigate any suspected violations of this Policy.

5.2 Suspension or Termination

We may suspend or terminate your access to the Hyperfy platform if your AI Agents violate this Policy or applicable laws.

5.3 Reporting Violations

If you become aware of any activity that violates this Policy, you must notify Hyperfy immediately at admin@hyperfy.ai.

6. AMENDMENTS

Hyperfy reserves the right to amend this Policy at any time. We will notify you of significant changes through email or our platform. Continued use of the Hyperfy platform after changes are posted constitutes your acceptance of the updated Policy.
